Special drawing rights

In freight law, the term is especially relevant under Article 23(3) and (7) CMR. Where goods are lost, compensation is generally limited to 8.33 units of account for each kilogram of gross weight missing. Article 23(7) CMR identifies the unit of account as the Special Drawing Right of the International Monetary Fund.

The liability limit is therefore not a fixed euro amount. Conversion into the national currency follows the valuation and conversion rules in Article 23(7) CMR and the date specified there. Whether the limit applies and whether higher compensation can be claimed also depends on the particular carriage and the requirements of Articles 24 and 26 CMR.
